The Flirty Guide Official Contest Rules for Flirty You Illustration(s)
1. Consent to Use Image: Entry in the contest is your consent to allow The Flirty Guide to use your image to create the Flirty Illustration to use in our masthead, on The Flirty Guide Website and The Flirty Blog with no expectation of compensation beyond the cartoon illustration accompanied by the Limited Use License listed below
2. Size of Image: The image will be 72 dpi and will always measure 200 pixels wide by 255 pixels high.
3. Delivery: Finished illustration will be sent to the winner by email.
4. *The Limited Use License
- The flirty illustration can be reproduced or incorporated into online websites and social networking sites as a profile picture or avatar.
- Will allow for any personal use that is not for profit.
- Not for profit means the image(s) may not be used for any materials or products that would themselves be made available for resale or profit.
- Not for profit also means the image cannot be used for business branding purposes without obtaining an expanded "Limited Use License for Logo Design and Brand Identity" license.
- The images may not be used for any materials or products that would themselves be made available for resale or profit. To obtain a Full Use License an additional fee is required.
- If an expanded license is required, a signed agreement and all agreed upon additional fees must be paid to the designer before the license takes effect.
5. Selection of Winners: You may enter each contest one time each month. Winners must reside in the United States and will be drawn at random using Random.org and will be announced each month on The Flirty Blog.
6. Alternates: If a winner declines or fails to send in their photo within 10 days of notification a new winner will be selected.
7. Design Interpretation: The design interpretation of the winners' photos into a Flirty Cartoon is at the discretion of the artist. Some cartoons may be more detailed than others to create a reasonable "likeness" of the winner. Samples of her work can be viewed by CLICKING HERE
(a) No purchase is necessary to enter or win.
(b) The contest is void where prohibited or where restricted by U.S., international, federal, state or local law.
(c) Entrants are required to provide truthful information. Sponsor(s) will reject and delete any entry (on-site, Internet, or mail-in) that it discovers to be false or fraudulent or to contain any incorrect statement.
(d) No further consideration will be provided to the contest winner.
(e)The winner will agree to hold TFG and it's Sponsors harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
(f) TFG and it's Sponsors are not responsible for technical, hardware, software or telephone failures of any kind, loss or delay of mail, lost or unavailable network connections, fraud or incomplete, garbled or delayed computer transmissions, whether caused by the Sponsors, users or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human error which may occur in the processing of submission which may damage a user's system or limit an entrant's ability to participate in the contest. TFG reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or with the operation of the contest.
(g) Any and all disputes, claims and causes of action arising out of or connected with this contest, or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest, but in no event attorney's fees.
(h)TFG reserves the right, in its sole discretion, but shall in no event be obligated, to cancel, terminate or suspend part or all of this contest should viruses, bugs, non-authorized human intervention, loss by any cause of mailed-in entry forms or other causes corrupt or impair the administration, security, fairness or proper play of the contest or for any other reason.
(i) TFG reserves the right to make changes to the rules of the contest, including the substitution of a prize or prizes of equal or greater value, which will become effective upon announcement and The Flirty Guide shall incur no liability with respect to such changes.
(j) Failure to comply with the contest rules may result in an entrant's disqualification at the sole discretion of The Flirty Guide.
(k) The Contest shall be governed by and construed in accordance with the laws of the State of California, U.S.A. Entrants in the contest, the winners and their guests agree irrevocably to conform to the non-exclusive jurisdiction of the Courts of such State and hereby waive all defenses of lack of personal jurisdiction and forum non conveniens. |
